What does recording a construction mean in Brazil?

It means updating the property registry to state that a building, extension or demolition occurred. The registry then reflects the physical condition documented in the submitted records.

Can a property with unrecorded construction be sold?

The discrepancy may hinder the deed, financing, valuation and transaction security. The practical ability to sell depends on the documents and the review by the parties, bank, notary and Property Registry.

Is an occupancy certificate enough?

Not always. In addition to the municipal document, the registry may require an application, technical documents, updated municipal records and applicable construction tax or social-security evidence.

Does the lawyer regularize the building with the municipality?

Must an old construction also be recorded?
