Property area and boundary correction in Brazil
We address discrepancies in area, perimeter and adjoining boundaries between the registry record and the property, coordinating the legal documents for an out-of-court or judicial route.
5,0 · 18 Google reviewsCorrecting the property description means amending the registry record when its area, perimeter, measurements or adjoining boundaries do not match the property. Legal counsel organizes title documents, consents, notices and responses to the Property Registry, coordinated with the survey produced by a qualified technical professional.
What a property correction may involve.
- Registry diagnosisWe compare the registry record, prior title documents, municipal records and technical documents to identify the source and extent of the discrepancy.
- Area and perimeterWe address corrections to total area, linear measurements, vertices and perimeter descriptions that do not match the surveyed situation.
- Adjoining boundariesWe organize the identification of neighbouring owners, consents and notices required in the proceeding.
- Out-of-court routeWe prepare and monitor the application before the Property Registry, including reasoned responses to registry office requirements.
- Judicial routeWe assess court proceedings when there is an objection, boundary dispute or no viable path to complete the correction before the registry.
- Technical coordinationWe align the legal documents with the plan, survey description and professional certification prepared by a qualified engineer, architect or surveyor.

- Registry reviewWe identify the current description, the title documents behind the record and the points requiring correction.
- Technical and document reviewWe check consistency among the plan, survey description, municipal records, occupation and chain of title without replacing the technical professional.

Common questions.
When is a property area correction required?
When the registry record states an area, measurements, perimeter or adjoining boundaries that differ from the surveyed reality. Counsel must first distinguish a registry error from a possession or title dispute.
Does a correction increase the property I own?
The recorded area may be corrected upwards or downwards according to the technical evidence. This does not create ownership of someone else’s land: the procedure corrects the property description. An overlap or title conflict requires a specific assessment and may prevent an out-of-court route.
Do neighbouring owners need to consent?
Consent may simplify the procedure. If it is not obtained, Brazilian registry law provides for notice and an opportunity to object. The next step depends on the documents and each adjoining owner’s response.
Does the lawyer prepare the survey plan?
No. The plan, survey description and technical certification are prepared by a qualified engineer, architect or surveyor. Counsel handles legal strategy, documents, the application, notices and registry requirements.
Can the correction be completed directly at the registry?
Many cases proceed out of court before the Property Registry. A material dispute, reasoned objection or title issue may require court proceedings.
How long does a property correction take?
Timing depends on document quality, required notices, registry office requirements and any objection. A responsible estimate can only follow review of the registry record and technical survey.
Does the registry describe the property incorrectly?
Send the registry record and explain the discrepancy identified. The initial review determines whether correction is the proper route and which documents will be required.
