What is the deadline to open probate?
60 days from the death (art. 611, CPC). Opening later does not bar probate but triggers a penalty on the ITCMD in São Paulo, so we recommend starting as soon as possible.
Can probate be done at a notary office?
Yes, when all heirs are adults and legally capable, there is consensus and no will (or it has already been processed in court). Extrajudicial probate is faster and cheaper than judicial.
